Sister Charles' case could go to Constitutional Court

The African Christian Democratic Party (ACDP) is disappointed that the Equality Court has dismissed Sister Charles’ case. But the ACDP is encouraged that the case could now go to the Constitutional Court.

Sister Wilhelmien Charles has taken a stand on her constitutional right not to do abortions. The matter was brought before the Equality Court yesterday, but referred to the Labour Court. The matter will be dealt with next year.

Sister Charles is challenging the Gauteng Health Department on practices in hospitals, which discriminate against staff who object to participate in abortions.

“We are disappointed that the Equality Court has dismissed the case. However, we are encouraged that Sister Charles will now have an opportunity to take her case to the Constitutional Court. This is where the matter actually belongs.” Cheryllyn Dudley MP for the ACDP and Health spokesperson said today.

“Unfair discriminatory practices in hospitals which negatively impact on staff who object to participating in abortion are unacceptable. It’s about time it was challenged”
